Real Estate Practice
Residential Settlement and Refinance Transactions Through the representation of home buyers and sellers, refinance borrowers, Realtors, builders, and numerous mortgage lenders and brokers, the firm has an active residential settlement and loan closing practice, with Richmond offices in the West End and South Side affording the convenience of both service and location.
Homebuilder Construction Loan Closings The firm represents a number of Richmond area homebuilders, two of which have consistently appeared in the metropolitan Richmond area list of the ten largest homebuilders. The firm has developed extensive experience in construction law issues, homebuilder construction loans, and has maintained experienced and capable representation in the related settlement transactions.
Multi-Family Housing The firm has represented the developer of a number of condominium projects in various neighborhoods in the Richmond metropolitan area and was involved in the preparation of condominium documents for these projects, as well as the documents for a mixed use residential/retail condominium. We have also closed a low-income housing tax credit transaction for a non-profit development company in Richmond. Members of the firm have extensive experience in handling apartment project sales and purchases.
Commercial Settlement and Loan Transactions Partners of the firm are principally responsible for representing clients in commercial property acquisition and loan transactions. The firm has also closed construction-permanent loans and served as lender=s counsel in commercial mortgage loan transactions for Wachovia Bank, N. A., BB&T of Virginia, Union Bank and Trust Company, Regions Bank and SunTrust Bank.
Commercial Development and Property Management The firm has represented a national drug retailer in its site development activities throughout Virginia and the developer of several out-parcel retail sites in Richmond area shopping centers. The firm currently represents several owners and property managers of local shopping centers and retail establishments.
Foreclosure The firm serves as Substitute Trustee(s) for many foreclosure proceedings through the Commonwealth of Virginia. Additionally, the firm serves as lender counsel for many foreclosures including private individual lenders, building supply companies and larger retail and commercial banks.
Business Practice Cawthorn, Picard, Rowe, Deskevich & Gavin, P.C. currently represents a broad range of business entities engaged in diverse enterprises and has established the experience, capability and competence to service a vast array of business concerns. We have conducted stock purchase transactions for both sellers and buyers, including non-compete agreements and deferred compensation packages. In addition, the firm has handled a variety of asset sales for both individuals and companies, including small retail and public service operations to large financial institutions. The firm is instrumental in the formation of numerous businesses, joint ventures and organizations of varying size and focus, including corporations, general and limited partnerships, limited liability companies.
Wills, Trusts and Estate Planning We represent and assist clients in the implementation of their estate plans to insure proper distribution of clients= assets and tax liability planning. We routinely draft wills, trust agreements, powers of attorney and medical directives as well as advise clients of various means to orderly and effectively transfer assets upon death.
Probate and Estate Administration Our attorneys assist executors, trustees and other personal representatives in the handling of probate and other estate administration matters, including the preparation of all required court filings and accountings. We also represent family members and beneficiaries to insure appropriate management and distribution of assets from estates, trusts and non-probate transfers.
